Additional Information
Employment-based visas allow corporations with a presence inside the United States to send workers to labor in or supervise a business venture in the United States. Certain other employment-based visas allow those who have achieved national or international recognition in their fields while in another country to come to the United States.
Finally, employment-based visas may be available to those who have attained the equivalent of a bachelor’s degree in their native country and who studied in certain fields such as the arts, science, and/or engineering. Some of these employment-based visas are rarely granted: documentation of the applicant’s eligibility is crucial to being granted one of these visas.
Product and Services
Individuals who have suffered certain persecution in their home countries or who have a reasonable and well-founded fear that such persecution would likely take place if they were sent back to their home countries may qualify for refugee status or asylum. Asylum is granted to those who are already physically present in the United States at the time the relief is requested; individuals who are outside the U.S. but seeking to enter because of persecution in their home country will apply for refugee status.
Regardless of whether a person is seeking asylum or refugee status, the applicant bears the burden of showing that he or she was the victim of persecution based on the person’s race, national origin, religion, and/or membership in a social group. If no persecution actually occurred, the applicant must show there is reason to believe such persecution of the applicant would most likely occur if the applicant was returned to his or her home country.
Applying for asylum or refugee status can be complicated and depend on making persuasive arguments supported by the proper type of evidence. Your Asheville immigration lawyer can help you tackle this challenge
